FAIR Act being decided on
August 6, 2003
For years, workers have been trying to recover damages for asbestos related illnesses. Linked to deadly and rare cancers, including mesothelioma, asbestos exposure has harmed a high number of people that have been unable to be compensated for their illnesses. Asbestos victims have been met with court delays and many people have died before ever receiving any compensation.
Companies declaring bankruptcy did not help the asbestos exposed victims either, and now lawmakers are trying to find a conclusion to the controversial matter. A proposal for the FAIR Act, or the Fairness in Asbestos Injury Resolution Act would create a trust fund that is worth over $100 billion financed by companies and insurance companies.
While the FAIR Act would allow asbestos victims to avoid long delays in the court system, however many critics worry that in severe asbestos related illnesses there will not be adequate compensation available. In addition, the number of people though to be affected by asbestos is estimated to be at a very large number, and many fear they will receive nothing before the fund is depleted. Some illnesses have a long latency period before symptoms appear, so the fund could be depleted far before victims realize they have developed diseases.
