"Former Naval Commander Awarded $1.9 Million for Illness"

CA San Francisco jury has awarded a former naval machinist $1.9 million for his asbestos related injuries resulting from years of work-related exposure to the deadly fibers. Charlton Clemmer and his wife Kay claimed in their lawsuit that former asbestos manufacturers and distributors John Crane Inc. and Thorpe Insulation Company were directly responsible for their defective product and failure to warn people about the deadly risks associated with asbestos.
Clemmer, who was active in the Navy from 1952 to 1972, was in charge of equipment maintenance and repair on several destroyers and the aircraft carrier USS YORKTOWN, exposing him to dangerous levels of asbestos inhalation. Following these duties, Clemmer also served as a marine machinist and a chief petty officer, where he was also regularly subjected to many asbestos products.
In 2004, Charlton Clemmer was diagnosed with mesothelioma cancer, a cancer directly correlated with excessive and prolonged asbestos exposure.
During the trial, the plaintiff argued that asbestos dangers have been known since the 1920s and its cancer-causing effects were confirmed as early as the 1950s.
I wish that companies whose products have caused serious injury would take note and responsibly address the human toll without time and again putting deserving plaintiffs like the Clemmers through a trial, commented attorney Gilbert Purcell, who is representing the Clemmer family. John Crane, Inc. refuses to settle any case and has taken this stance for over 20 years despite verdict after verdict against them. Its their rightbut its still unfortunate, he added.
The jury awarded $550,000 for economic damages, $1.1 million for non-economic damages, and $250,000 for loss of consortium to the Clemmer family.
