Asbestos Victim Files Suit Against 90 Companies
A man who is suffering from mesothelioma, which is caused only by asbestos exposure, filed a lawsuit in a Madison County Circuit Court against 90 companies, including Ford Motor Company, John Crane, Owens-Illinois, Dow Chemical, General Electric, Sears, Viacom, and General Motors.
Allen Beyersdorf claims that over the course of his employment, and while doing home automotive repairs, he was exposed to asbestos fibers from certain products he was working on, with, and around.
The complaint states, “the plaintiff’s exposure and inhalation, ingestion or absorption of the asbestos fibers was completely foreseeable and could or should have been anticipated by the defendants.”
Beyersdorf alleges the defendants should have known, or did know that the asbestos in their products was toxic, and extremely hazardous to human health. He further claims that the defendants used asbestos when safer substitutes were available, and that the companies failed to supply sufficient instructions concerning working with asbestos safely.
He also claims that none of the defendants required or advised their employees of proper hygiene practices to prevent or reduce carrying asbestos fibers to the home.
He seeks at least $250,000 in damages to pay for the treatment of his mesothelioma, which he claims
resulted from the 90 companies’ negligence concerning asbestos use, and for the lost wages his sickness will cause.
The complaint also states, “in addition to compensatory damages, an award of punitive damages is appropriate and necessary in order to punish the defendants for willful, wanton, intentional and reckless misconduct and to deter them and others from engaging in like misconduct in the future.”
