Asbestos Suit Settled in Arkansas

A settlement was recently reached in the city of Altus regarding a lawsuit filed by property owners who claim that their property was damaged by asbestos.

The Altus City Council agreed to the settlement after the property reportedly became contaminated after a 2001 drainage project.

Couple’s Property Contaminated with Asbestos

Paul and Shannon Burns, who own the Owl’s Roost Café, filed the suit.

The Burns’ claim that the city caused harm to both them and their property when a 48-inch drainage culvert was installed across a portion of their land.

The plaintiffs claim that the fill material, which was used when the culvert was installed, contained asbestos from a nearby demolition site.

Mayor Veronica Post and the city are being accused of knowing that the hazardous substance was present on the property.

Settlement Reached

Under the terms of the settlement, the city is required to pay the Burns’ $19,441.

Although the mayor stands firm that the city had no prior knowledge of the contamination, she has also agreed to cover the expenses for the cleanup of the property.
