Thursday, April 23rd, 2009

A man living in Arizona has filed a suit against 67 corporations claiming that because of their negligence he is now living with mesothelioma.

He also claims that his wife was exposed to asbestos when he carried the fibers home on his clothing while employed as an assembly worker from the 1950’s through the 1970’s.

Man Claims Workplace Exposure

Ervin Rymaszewski says that during his employment working in automotive repairs, he was exposed to asbestos fibers from the products that he was using and working around.

“Dust created by working with and around asbestos and asbestos-containing products would permeate the person and clothing of the plaintiff’s wife,” states the complaint. “This dust contained asbestos fiber.”

Rymaszewski was employed for over twenty years as a welder, truck driver, lineman and laborer at various companies throughout Illinois.

Lawsuit Details

“The plaintiff’s exposure and inhalation, ingestion and absorption of the asbestos fibers was completely foreseeable and could have been anticipated by the defendants,” says the suit.

Rymaszewski has reportedly developed mesothelioma as a result of the companies negligence and is supposedly disabled and disfigured.

Plaintiff Seeks Compensation

Rymaszewski is seeking compensation to help pay for the cost of his treatment.

He is reportedly seeking at least $250,000 in damages due to negligence and conspiracy from the defendants.
