Thursday, April 23rd, 2009

Owner of a Plattsburgh, New York asbestos air monitoring company was found guilty of purposely falsifying asbestos abatement reports. Mark Denoyers was convicted of multiple charges, including conspiracy, fraud and lying to the U.S. Environmental Protection Agency and is waiting to be sentenced Feb. 13, 2009.

Asbestos Abatement Company Owners in on the Conspiracy

Denoyers, owner of Adirondack Environmental Associates was working with the owners of two asbestos abatement companies in a conspiracy that left many individuals and families at risk of harmful asbestos exposure.

Denoyers reportedly generated false reports stating that homes and commercial buildings were freed of toxic asbestos fibers after the companies were finished with asbestos abatement projects. Denoyers knowingly put individuals and families at risk of ingesting toxic asbestos fibers by telling them that the asbestos had been properly removed when in fact, it had not.

Company Owners Found Guilty

The two asbestos abatement company owners that were conspiring with Denoyers testified against him during the two week trial. John Wood, owner of J & W Construction, Inc. pleaded guilty a week before the trial, admitting to his role in the conspiracy. Curtis Collins, owner of Adirondack Asbestos also admitted to having a part in the scheme and testified against Denoyers during the trial.

All three men have been convicted on several counts and are facing maximum punishment which includes prison time, hefty fines and restitution to the victims. They will all be sentenced by federal district court judge David N. Hurd on Feb. 13, 2009.
