Keller worked on the railroad for several years and according to the plaintiff, during this time he was exposed to toxic dusts and asbestos fibers.

Lawsuit Filed After Man Dies from Fatal Illness

The suit names CSX Transportation, which was formerly Chesapeake & Ohio Railroad, as the main defendant.

“As a direct and proximate result of his exposure to the harmful dust, fumes and other products without any lack of due care on his part, the decedent contracted lung cancer and other diseases related to such exposure,” states the lawsuit.

According to the suit, it was the company’s responsibility to provide a safe work environment for employees under the Federal Employer’s Liability Act, but they failed to do so.

Joseph Keller is seeking compensatory and punitive damages in the suit.
