Fraternity House Asbestos Suit to be Settled

A lawsuit filed against Colorado College in 1999 on behalf of 22 fraternity members is soon to be settled after seven years.

The suit claims Colorado College officials were aware that the Phi Gamma Delta fraternity house had asbestos in the basement, but allowed students to live there without warning them of the dangers or removing the toxic materials.

While, the court has dropped three claims since 1999, a remaining three lawsuits alleging fraud, breach of housing contract, and violation of the Consumer Protection Act are still ongoing.

Chris J. Melcher, Colorado Colleges attorney announced that the cases are expected to settle shortly. CC is and has been fully prepared to litigate this case, Melcher said. We never did anything wrong.

However, according to court documents, the college knew asbestos was in the mechanical room as pipe and heat exchanger insulation and on some exposed overhead pipes.

While Colorado College officials admit that a consultant report prepared in 1984 indicated the presence of asbestos in the basement of the Fiji house, they claimed the mechanical room remained locked and students didnt have access.

The students allege that there were dangerously high levels of asbestos in the basement and claimed their fear of developing an asbestos-related illness was affecting their ability to live a normal life.

Plaintiffs also now live in constant fear that they will develop an asbestos-related health problem, the lawsuit alleges. Every time one of the plaintiffs doesnt feel well, their first thought will be that they have developed an asbestos-related disease.
