Settlement Reached in Massive Asbestos Suit

Thursday, April 23rd, 2009

One more settlement has been reached in a lawsuit filed on the behalf of more than 2,000 plaintiffs against about 400 defendant corporations.

The suit claims that the plaintiffs or those they represent were allegedly sickened as a result of their exposure to asbestos-containing products or facilities.

More than 2,000 Cases

While each of these 2,000 plaintiffs’ cases were filed together as one lawsuit under one case number, each case is being handled independently.

The amount and terms of this most recent settlement, reached on April 2, were not disclosed.

This is settlement number 220 in the lawsuit. A significant number of the individual cases were decided before trial.

The Lawsuit

According to the original complaint, defendant companies including H.B. Zachry, Foster Wheeler, AC&S, Brown Associates & Root, Bechtel and Dresser and several distributors and contractors distributed, removed, sold or installed products containing asbestos that were dangerous, defective and posed unreasonable risk to those who came into contact with them.

According to the plaintiffs, the defendants relabeled, re-branded or otherwise marketed and sold asbestos-containing products that the plaintiffs were exposed to.

According to the lawsuit, the defendants were also negligent in continuing to distribute and/or manufacture asbestos-containing products well after the dangers associated with the substance were well known and documented.

One defendant, 3M Corporation was also named specifically for providing breathing masks that did not adequately protect workers against asbestos inhalation.

The suit seeks damages for past and future pain, suffering, medical bills, mental anguish, lost wages, physical impairment, disfigurement, and funeral and burial bills in case of death.
