"Asbestos Trial Delayed"

The asbestos case against W.R. Grace & Co. has been officially delayed due to the prosecutions pending appeals with the 9th U.S. Circuit Court of Appeals. This asbestos trial was originally slated to begin on September 11, 2006 and is now postponed indefinitely.

The appeal transfers the asbestos cases jurisdiction and prevents the trial from moving forward as planned, says U.S. District Judge Donald Malloy, who granted the prosecutions request to delay trial.

The asbestos case involves criminal claims against Grace &Co. and seven of the companys former managers. These individuals are charged with conspiring to conceal health risks posed years ago in Grace & Co.s vermiculite mine in Libby.

In Libby, hundreds of people have become seriously injured or killed from exposure to asbestos in the vermiculite.

In the same case, Judge Malloy denied one of the defendants requests for a trial postponement. William McCaig, a former manager of the Libby mine, had asked the judge for a postponement because he just had heart surgery.

The judge denied the request, except in the event of an acute health problem, and due to the trial postponement.
