Father and Son File Asbestos Suit Against Chrysler

A man living in Michigan has filed an asbestos suit against 51 defendants claiming that he was exposed to asbestos fibers that were on his father’s clothing.

The man, who has been diagnosed with mesothelioma, blames his father’s former employers for the illness that he and his father now have to live with.

Man Claims Second Hand Asbestos Exposure

Walter Nalezyty’s father was employed at Chrysler as a metal finisher and bump out installer and claims that his father worked around asbestos while at the company.

“Dust created by working with and around asbestos and asbestos-containing products would permeate the person and clothing of the plaintiff’s father,” says the complaint. “This dust contained asbestos fiber.”

Nalezyty says that his father would carry the asbestos fiber home where the dangerous substance would become airborne once again.

His father was also diagnosed with mesothlioma and was told that the illness was wrongfully caused.

Asbestos in the Workplace

Nalezyty was employed from 1964 to 1991 as a pattern maker and installer at various Chrysler locations throughout Illinois and Michigan.

He claims that during his employment, he was exposed to asbestos during non-occupational work projects such as home and automotive repairs and remodeling.

The complaint also states that the defendants failed to advise their employees of hygiene practices that could have reduced their exposure and prevented him from carrying the fibers home on his clothing.

“An award of punitive damages is appropriate and necessary in order to punish defendants for their willful, intentional and/or reckless misconduct and to deter defendants and others from engaging in like misconduct in the future,” states the suit.
