Hotel Operator Guilty of Violating Clean Air Act

Dan Hulsing pleaded guilty in a Missouri courtroom this past week for violating the Clean Air Act while acting as superintendent of a Clarion Hotel.

Hulsing Hotel Missouri Inc. received a $200,000 fine in a federal court for removing asbestos, a cancer-causing agent, from the hotel during renovations.

Violation Tip-Off

On an anonymous trip to the Clarion Hotel due to a tip-off, the Kansas City Health Department arrived at the hotel to find that workers were illegally removing asbestos without the supervision of an asbestos contractor.

Husling admits that he was not trained in the removal of asbestos and that the renovations had been on going for a 60-day period while in violation of the Clean Air Act.

The Clean Air Act states that property owners must properly remove asbestos from buildings before any construction begins.

Guests Risk Being Exposed to Asbestos

During the time of the asbestos removal, guests were occupying rooms at the Clarion Hotel putting them in danger of being exposed to asbestos.

“Hotel guests pay for comfort and deserve to breathe clean and safe air,” says Granta Nakayama, the assistant administrator of enforcement and compliance assurance for the Environmental Protection Agency.
