Widow Sues over Husband Mesothelioma Death

A woman who was left a widow when her husband died from mesothelioma has filed a wrongful death lawsuit against many companies claiming her husband’s death was the result of their negligent conduct.

The lawsuit was filed Feb. 9 by Joyce M. Tolman in Knawha Circuit Court on behalf of her late husband, Terry Warren Tolman.

Among the defendants listed in the suit were General Electric Company, Allied Chemical Corporation, Union Boiler Company, Graybar Electric Company, Nitro Industrial Coverings Inc., Vimasco Corporation, and Chevron U.S.A.

The Suit

The lawsuit claims that through his employment, Tolman was forced to work around several products that contained asbestos, including insulation. As a result, the suit states, he developed the life-threatening asbestos-related disease mesothelioma.

According to the suit, the defendant companies continued to use the products with asbestos despite the fact that they knew it was dangerous and could cause lung cancer and other serious diseases. They also neglected to warn or inform Tolman of precautions he could take to limit his inhalation of the hazardous fibers.

As a result of this negligence, the suit claims Tolman developed mesothelioma. Tolman has also incurred great medical and pharmaceutical expenses, as well as psychological losses and a decreased enjoyment of life.

The suit alleges the companies acted deliberately in their negligence and claims wrongful death.

Joyce Tolman seeks compensation for her late husband’s damages as well as punitive damages.
