Settlement Reached for Illegal Asbestos Removal

A $90,000 settlement was reached in the case against two companies who allegedly removed asbestos from an industrial building illegally.

Kane Management Group, LLC and 85 Industrial Park II, LLC, will pay the specified amount in civil penalties.

Unlicensed Workers Removing Asbestos

After doing an investigation, the Department of Environmental Services (DES) discovered that unlicensed workers employed with Kane were removing asbestos-containing flooring from the building.

The DES hired licensed contractors to finish the project after their findings.

The state law requires that any workers handling asbestos be certified and the DES must be made aware of the removal before it begins.

Companies Fined

Kane is now required to pay $90,000 in civil penalties and $10,000 of the settlement money will go towards funding air pollution and climate change education at the Seacoast Science Center in Rye, New Hampshire.

“This case demonstrates the importance of complying with state laws that protect workers, the public and the environment from potential asbestos risks,” explains State Attorney General Kelly A. Avotte.

The DES Assistant Commissioner Michael J. Walls agrees with Avotte stating, “These requirements are meant to prevent the release of asbestos fibers into the environment and the exposure of unprotected workers to asbestos-contaminated material.”
