Lawsuit Filed Over Fire in Ohio

The Ohio Attorney General’s Office has filed a suit against a company who they claim put the public’s health at risk when they burned debris from an old building.

The company, which is located in Mahoning County, burned the debris from a building that was torn down in Niles about five years ago.

Demolition of Building Causes Controversy

The lawsuit was filed against Mark A. Mirich, the owner of All Demolition of Struthers.

In January 2003, the company reportedly tore down a building and set fire to the debris that was leftover.

Amongst the debris was roofing material, wire and wooden beams, all of which are believed to have been infested with asbestos.

Suit Seeks Compensation

The suit accuses Mirich of failing to get the site inspected for asbestos before beginning the demolition.

The company also allegedly didn’t notify the Ohio Environmental Protection Agency before tearing down the building.

“By engaging in open burning, failing to inspect the facility and failing to give notice to the Ohio EPA, the defendant has increased the risk to public health and the environment by thwarting the ability of the Ohio EPA to ensure that they quality of the air in northeast Ohio is protected,” explained the lawsuit.
