Asbestos Lawsuit Filed Over Mesothelioma Death
A widow in Missouri has filed an asbestos lawsuit against 187 companies claiming her husband’s death was a direct result of frequently inhaling large amounts of asbestos fibers in the workplace.
Gregory Gundlach worked as an electrician and laborer in Missouri and Illinois from 1963 to 2003 where he was exposed to dangerous levels of asbestos. In December 2004 Gundlach was diagnosed with mesothelioma, a rare, but deadly disease almost exclusively linked to asbestos exposure. Gundlach died less than two months later.
Details of the Case
According to the lawsuit, filed by his wife Kathleen, Gundlach’s previous employers failed to exercise the standard level of care or caution for Gundlach’s safety when they used asbestos in their products even though they were fully aware of the serious risks associated with the toxic substance.
“The decedent’s exposure to and inhalation, ingestion or absorption of the asbestos fibers was completely foreseeable and could or should have been anticipated by the defendants,” states the filed compliant.
The defendants in the case include AutoZone, Bondex, Chevron, Anheuser Busch, DaimlerChrysler, Ford Motor Company, Goodyear, General Electric, Sears, The Pep Boys, Exxon, and more.
The lawsuit seeks more than $400,000 in economic and non-economic damages including pain and anguish, medical expenses, loss of enjoyment of life, and more. Gundlach also seeks punitive damages to punish the companies for their alleged misconduct.
