Michigan Women Files Mesothelioma Lawsuit

A woman living in Michigan filed an asbestos lawsuit claiming she developed mesothelioma cancer after being wrongfully exposed to asbestos. Dixie Lee Kimble filed the lawsuit Sept. 23 against 144 defendant corporations in Madison Circuit Court.

Asbestos Exposure at Work

Kimble claims she was wrongfully exposed to toxic amounts of asbestos while working as a laborer at Seward Luggage in 1973, as a laborer at Hush Puppies Shoe Factory in 1976, and as a laborer at various other locations in 1978. Kimble claims she also worked as an assembler at Electrolux from 1978 to 2006.

Asbestos Exposure at Home

According to the lawsuit, Kimble was also exposed to asbestos while living at her parents’ home. The suit claims she was exposed to asbestos when her mother had the house remodeled. The remodeling projects lasted from 1966 to 1971. The suit also claims her father’s installation of a roof and work on asbestos-containing tractor clutches also attributed to her illness.

Asbestos Exposure Led to Mesothelioma

The mesothelioma lawsuit claims that Kimble’s exposure to asbestos, both at work and at home, led to the development of mesothelioma. She was diagnosed with the fatal cancer March 21. Kimble claims that her exposure was foreseeable and that the defendant companies should have warned her about possible effects of their products.

Seeking Compensation

Kimble is suing the defendant companies for compensation to cover medical bills, lost wages and present and future emotional pain and suffering caused by her illness.

She is seeking sums in excess of $100,000 for punitive damages, $100,000 in exemplary damages, $150,000 in economic damages and $150,000 for compensatory damages, which includes the amount of the lawsuit.
