A man living in Missouri filed an asbestos lawsuit against 30 defendant corporations on behalf of his wife who died from mesothelioma cancer.
James A. Walsh filed the lawsuit in Madison County Circuit Court, Sept. 17. He claims his wife, Dianna Walsh, was wrongfully exposed to asbestos fibers that her father carried home on his clothes. Dianna’s father, Robert Holder, worked as a boiler operator at the Kansas City Municipal Auditorium and as a plumber and heating technician from 1954 to 1972.
Lawsuit Claims Death was a Result of the Defendants’ Negligence
Walsh is suing the defendant corporations for negligence and wrongful exposure to asbestos. He claims Dianna’s third-party exposure should have been foreseeable and anticipated by her father’s employers.
Husband Seeks Compensation for Damages
Walsh is suing the 30 defendant corporations for sums in excess of $200,000. The lawsuit seeks compensation for medical costs, lost wages lost future financial support and funeral and burial costs. Walsh is seeking compensation for the physical and mental pain and suffering endured by his wife before her death, and for the emotional damage her death has caused him and his family.
Regulations against Third Party Asbestos Exposure
Since the discovery of asbestos’ harmful effects, government and state regulations have been enforced to protect the safety of workers who handle asbestos and their family members. Employers of workers exposed to asbestos must provide their employees with the proper protective gear and must also provide a facility with showers and locker rooms so the workers can shower and change into fresh clothing before leaving the job site.
Employers who fail to follow these, and other, guidelines may be held liable for any illness such as mesothelioma cancer, caused by asbestos exposure.
