Thursday, April 23rd, 2009

A woman living in Missouri filed an asbestos lawsuit on behalf of her husband who died from lung cancer. Nancy Goetzmann filed the suit against 79 defendant corporations, claiming her husband, Steven Goetzmann died from lung cancer after being wrongfully exposed to asbestos.

Asbestos Exposure at the Workplace

According to the lawsuit, Steven was exposed to toxic asbestos fibers during his employment with various companies. He allegedly worked as a laborer at John Deer Plant in Moline in 1970, as an electrician for International Harvester Company in East Moline from 1971 to 1982, and as an electrician in Ottumwa from 1979 to 1980.

Steven also worked as an electrician at General Motors in the Guide Division from 1984 to 1996 and as an electrician for the Missouri branch from 1996 until his death in January 2007.According to the lawsuit, Steven’s fatal exposure to asbestos was foreseeable and should have been prevented by his employers.

Wife Seeks Compensation for her Husband’s Death

Because Steven’s exposure to asbestos was allegedly foreseeable and could have been prevented, Nancy is seeking compensation for his death. She claims that Steven’s illness resulted in hefty medical bills and funeral costs, in addition to lost wages. Nancy is suing the defendant corporations for the cost of the medical and funeral bills, lost wages and loss of future financial support.

She is also seeking compensation for the physical and mental anguish Steven went through before his death and for the emotional pain and suffering she has experienced.

The 11-count lawsuit seeks more than $200,000, economic damages in excess of $150,000 and compensatory damages in excess of $150,000. The lawsuit is also suing for punitive damages to penalize Ferris Kimball Company, Sprinkmann Sons Corporation, Sprinkmann Insulation and Young Insulation Group of St. Louis for their wrongdoing in an effort to prevent future negligence.
