“Ohio Asbestos Reform Ruling

The nation’s first statewide law creating objective medical criteria for asbestos litigation (HB 292) is temporarily taking effect after a ruling by the Ohio’s Eighth District Court of Appeals. The court has denied in its entirety an alternative writ seeking to block the asbestos litigation from taking effect until further arguments are presented. The bill was enacted in May 2003 and does not allow people who have been exposed to asbestos but are not yet suffering symptoms of illness to file suits in state courts. A deadline has also been set for dispositive motions to be filed on or before September 20 with any responses due by October 12.
