Wisconsin Supreme Court Says Asbestos Needs Better Testing

According to a new ruling in Wisconsin, asbestos tests for whether or not building material contain the toxic substance are going to be under stricter guidelines from now on.

The ruling came in the midst of the case of the State of Wisconsin v. Harenda Enterprises, Inc.

Supreme Court Appeals Ruling

The Supreme Court supposedly appealed a ruling, which held that the correct method is to average the asbestos-contents of multiple layers of building materials.

The state instead favored the EPA’s suggestion of treating each layer of material as its own entity and judging the level of asbestos by that.

EPA Guidelines Favored

The state reportedly argued that the state statute, which was relied on by the Court of Appeals, was ambiguous in whether it averaged the test results.

According to Justice Anne Walsh Bradley, the EPA’s interpretation is inconsistent with the statute; however, the Supreme Court thought otherwise.
