Worker Sues For Asbestos Illness

A man who filed a suit for asbestos exposure, died from asbestosis and lung complications before the case was heard in court.

Now, the suit, which was being carried out by his estate, is being nixed for not being filed before a deadline.

Lawsuit Filed

Roger Herring filed suit against Todd Shipyards Corp. after he developed mesothelioma while employed at the shipyards.

Todd Shipyards Corp. is known as the Pacific Northwest’s largest private shipyard and has had several suits filed against them in relation to workplace shipyard asbestos exposure.

Case Misses Deadline

According to the state Supreme Court, the suit for the now deceased man, can’t go through because Herring missed a filing deadline.

Before his death, Herring argued that the shipbuilding company had a responsibility to give his labor union notice of bankruptcy and they failed to do so.

Herring worked for Todd’s during the 1960’s and 1970’s and was a member of the Asbestos Workers Union Local 7.

Herring’s estate continued fighting after he passed away from his asbestos caused illness, though Herring wasn’t able to be rightfully heard in court.
